Sam Walker was issued a warning by a judge after claiming “I don’t wanna be sat in a court all f***ing day wasting my f***ing time” during a TikTok video. The 42-year-old, of The Strand in Liverpool city centre, appeared before Liverpool Crown Court today, Wednesday, after being charged with one offence of sending a communication threatening serious harm.
However, the prosecution confirmed during a brief hearing that it would offer no evidence in relation to the count, which alleged that he had sent threatening voice notes to a woman. The case against him was therefore discontinued.
But, with proceedings having concluded, the ECHO can now reveal that Walker was previously rapped during his plea and trial preparation hearing in October over a social media post, with Judge Louise Brandon having told his then counsel Robert Wyn Jones: “You told me on the last occasion, on instruction, that the reason Mr Walker did not attend was because he was in hospital.
“I raised concerns about that hospital visit, because it coincided with his court appearance. You can well imagine my surprise when I became aware of some material on the internet.”
Judge Brandon thereafter asked for a five-minute video which Walker had posted to TikTok on the evening of his earlier no show in court, after he claimed to be in A&E at the Countess of Chester Hospital for treatment after being “stabbed and shot”.
In the clip, Walker could be heard wrongly telling his 138,000 followers that the charge he faced was making threats to kill. He said: “The threats to kill was on a person that rang the hospital where my babies were born. The first day my babies being born, they rang the hospital and made a lie up saying Sam Walker’s got firearms to have me put in the cells.
“I found out who it was, and all I done was messaged one of his family members and said ‘tell him his karma is coming soon’. Do you know what they done? Arrested me, kept me in the cells from Friday to Monday and put me in the crown court for a threat to kill. The judge knew it was a load of b****cks, but they charged me with it. I won’t get found guilty on it.
“It was for 10am this morning and yous f***ing know that I like my sleep. I like my sleep la. F***ing hell. I don’t wanna be sat in a f***ing court all f***ing afternoon. I’m a f***ing busy guy la. F***ing hell. I’ve got appointments, I’ve got things to do, I’ve got business to do. I don’t wanna be f***ing sat in a court all f***ing day wasting my f***ing time over a charge that’s a load of my f***ing b****cks.
“Sam Walker, we find you not guilty. That’s what it’ll be. When I go on trial for that and I explain to the jury, I’ve just come back from Africa after saving thousands of thousands of lives, I come back.
“I had two daughters that were on the way to be born. I went the hospital. It was the greatest moment of my life. After being shot and stabbed, I signed myself out of hospital to go and see my babies being born.
“I’ve been stabbed in my brain, had some of my skull removed, shot and stabbed multiple times. I allowed myself to get better and strong, ready for my daughters to be born.
“Then we had a little peasant who rang the hospital and had a load of innocent mothers and fathers petrified when armed police have come running in saying Sam Walker has firearms. I didn’t. It was a lie by these little weirdos. So I found out who it was.
“And the reason why I’m stood before you today your honour, jury, is because I found out who rang the hospital. All I said to his family member is tell him his karma is coming soon.
“Where the f*** does that fit into a threat to kill? Where is that even a threat to kill you little weirdos. That is not a threat to kill. But he went to the police. But that’s what they do to try to play the victim even though they were the ones harassing me.
“My barrister said to me, look, this is perfect for a trial. I will never be found guilty. That’s not a threat to kill. That’s a not guilty. That’s exactly what that is.
“You must understand, when one has been up till about 4am live on TikTok, the last thing I wanna f***ing do is go to a f***ing court and sit there all bloody day. I’m a busy man.
“I hadn’t even had my cup of coffee in the morning guys. It got till about 10 o’clock. I’m looking at my f***ing watch thinking, it’s like 10 past 10. The court starts at 10 o’clock.
“I’m not even dressed and I’ve not even had a f***ing cup of tea. No bloody way. F*** off. F*** you. F*** you. I need a f***ing cup of tea.
“I tell you what I’m going to do. I’m going to go and have my cup of tea, go to the toilet, have a number two, have a shower, look all handsome as I do and then I will go to the hospital where I was meant to go anyway to get my operation.”
Walker appeared sheepish in the dock as the video was played, raising his hand as if wanting to speak on several occasions, although he did not ultimately do so. At the conclusion of the footage, the judge added: “Perhaps it comes across better on TikTok than it does in court. I asked for the case to come back in because there seemed to be a suggestion that what I had been told was not in fact accurate.”
While Judge Brandon confirmed that police had made enquiries and established that Walker did attend hospital on the day in question, she added: “It turns out that it is his TikTok followers he has been misleading and not the court. If he chooses to opine about this case in such detail, including legal advice, he may be exposing himself to the risk of further charges and he may be undermining his defence.
“I think Mr Walker needs to give very thoughtful care to this. On the face of what he told his TikTok followers, he is at risk of the commission of further offences and failing to surrender.”
The ECHO previously reported how, in a different video, Walker said he was at Arrowe Park Hospital when he was arrested on suspicion of possession of a firearm. He alleged he was detained by armed officers and detained to be questioned. A spokesperson for Merseyside Police later confirmed that no firearm was found.
Walker’s case in relation to the allegedly threatening voice notes was discontinued this afternoon after the prosecution said that there was no realistic prospect of conviction. Paulinus Barnes, appearing for the crown, told the court that no evidence was being offered, and Judge Robert Trevor-Jones therefore entered a not guilty verdict.
